Rental Terms
All vehicle rentals are governed by a comprehensive Rental Agreement provided at the time of booking confirmation or upon vehicle collection. This agreement outlines the specific terms, conditions, insurance coverage, fees, and your obligations for the rental. In any case of discrepancy between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Renting a vehicle requires:
- To rent a vehicle from Hardgate, you must be at least 21 years old, although age restrictions may differ based on vehicle type. Drivers under 25 may incur extra charges. A valid driving license for the relevant vehicle category is required, along with identification and proof of address. Valid payment details and a security deposit are also necessary, along with any other requirements noted in the Rental Agreement.
Booking and Payment Process
- Reservations with Hardgate can be made via our website, by telephone, or directly at our Dartford office. To confirm your booking, a deposit may be necessary. The remaining balance and a security deposit are usually collected at the time of vehicle pickup. All prices are listed in British Pounds (£) and include VAT when applicable. We accept major credit and debit cards, with secure transactions handled by trusted payment processors.
Vehicle Pickup and Drop-off
- At the time of vehicle collection, it is important to conduct a thorough inspection and report any existing damage without delay. A vehicle condition report will be prepared and signed by both parties. The vehicle should be returned in the same condition it was collected, accounting for normal wear and tear. Any new damage will be evaluated and charged as necessary. Please return the vehicle with the same fuel level as when picked up; otherwise, refueling fees will apply. Late returns may result in additional charges, so let us know promptly if you expect to return the vehicle late. You will also be responsible for any parking fines, traffic violations, or other charges that occur during your rental, along with a processing fee.
Insurance and Liability Policies
- All rentals include basic third-party insurance. Details regarding coverage and excess amounts can be found in your Rental Agreement. Additional insurance options may be available to lower your financial liability. It is important to review these options thoroughly. You remain liable for any damage or loss up to the excess amount, unless additional insurance is purchased. Any damage resulting from negligence, misuse, or violation of these Terms is your responsibility, regardless of existing insurance coverage.
Cancellation and Modifications
Cancellation and amendment policies differ depending on the type of booking and the notice given. Please consult your booking confirmation or Rental Agreement for precise information. Be aware that late cancellations or no-shows may incur additional charges.
Prohibited Activities
Prohibited Uses of the Vehicle
- The vehicle may not be used for any unlawful activities. This includes racing, rallying, off-roading, or similar high-risk pursuits. Transporting hazardous materials is prohibited. Sub-letting the vehicle or permitting unauthorized drivers is not allowed. Driving under the influence of alcohol or drugs is strictly forbidden. The vehicle must be used only for its intended purpose, and adherence to passenger and weight limits is mandatory. Operating the vehicle outside of the agreed geographical boundaries requires prior approval.
Breach of these terms may lead to rental termination and extra fees.
8. Liability Restrictions
To the fullest extent allowed by English and Welsh law, Hardgate Car Hire will not be responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business, resulting from your use of our services. Our liability for any claims will be limited to the total amount you paid for rentals in the past 12 months. This limitation does not apply to liability for death or personal injury due to negligence or fraud.
Governing Law and Jurisdiction
These Terms are regulated by the laws of England and Wales. Any disputes will fall under the exclusive jurisdiction of the courts in this region.
Updates to Terms
Hardgate reserves the right to update these Terms at any time. Changes take effect immediately upon posting on our website, and your continued use indicates acceptance of the revised Terms.
